General Terms & Conditions 103rooms

§ 1. Wird ein / mehrere Zimmer / Apartment bestellt, bestätigt oder bereitgestellt, so ist ein Mietvertrag zwischen dem Gast und 103rooms zustande gekommen.

§ 1. Any of the following will constitute a contract on these terms between the guest and 103rooms: where one or more rooms have been requested, confirmed or reserved.

§ 2. Der Vertrag über ein Zimmer / Apartment beinhaltet Aufenthalt und Übernachtung ohne Frühstück(*). Die Nutzung der Küche ist dem Gast im Rahmen der Mietzeit freigestellt. Nicht zulässig sind vom Mietzweck abweichende Nutzungen insbesondere solche welche gegen die allgemeine Hausordnung und Lärmschutzverordnung verstoßen.

§ 2. The rental agreement refers to an overnight stay excluding breakfast(*). The use of the kitchen remains optional to the guest during the entire rental period. Inacceptable is any use other then for the intended purpose, especially such as would breach the general regulations of the house and regulations in relation to noise control.

§ 3. Die Räume, insbesondere die Küche sind in ordentlichem Zustand zu verlassen. Alle über die normale Verschmutzung hinausgehende Verunreinigung, die 103rooms Zusatzkosten verursacht wird dem Gast gesondert in Rechnung gestellt.

§ 3. All rooms, especially the kitchen, are to be vacated in orderly condition. Any severe mess left by the guest may incur additional costs to the guest.

§ 4. Der Abschluss des Mietvertrages verpflichtet die Vertragspartner für die gesamte Dauer des Vertrages zur Vertragserfüllung. Der Vertrag kann nicht einseitig gelöst werden.

§ 4. The rental agreement remains binding for both contracting parties for the whole duration of the agreement, and both parties are bound to comply with the terms and conditions. The guest cannot terminate this agreement unilaterally.

§ 5. Werden vom Vertragspartner 103rooms erbetene Vorauszahlungen nicht zum geforderten Termin geleistet, so entbindet dies 103rooms unmittelbar von getroffenen Vereinbarungen.

§ 5. If requested pre-payments are not made to the contracting party 103rooms, we are instantaneously exempted from complying with all arranged agreements and from providing any accommodation.

§ 6. Das reservierte Zimmer / Apartment steht dem Gast am Anreisetag von 17:00 bis Abreisetag 14:00 zur Verfügung. Eine spätere Abreise als 14.:00 (late check out) erfordert eine entsprechende Buchung und ist mit Zusatzkosten verbunden. Ebensolches gilt auch für vorzeitige Anreisen vor 17:00 (early check in)

§ 6. The reserved room / apartment is made available to the guest on the date of arrival from 5pm until 2pm on the departure date. Departure after 2pm (late check-out) requires an appropriate booking and incurs extra cost. The same applies to an early arrival before 5pm (early check-in).

§ 7. Reservierungen werden bis 20:00 aufrecht erhalten. Bei späterer Anreise wird um Garantiezahlung für die Buchung im voraus gebeten. Danach behält sich der Vertragspartner 103rooms vor, das Zimmer anderweitig zu vermieten. Bei Nichtanreise wird eine No-Show Rechnung von 90 % der vereinbarten Leistungen fällig.

§ 7. Reservations remain open until 8pm only. Later arrival must be by arrangement and a deposit must be paid for the booking in advance. Thereafter, 103rooms reserves the right to rent the room to other persons. If guests do not arrive, a no-show payment of 90% of the agreed price will be due.

§ 8. Dem Gast bleibt vorbehalten, nachzuweisen, dass dem Vertragspartner „103rooms“ durch die Nichtinanspruchnahme kein oder ein niedrigerer Schaden als die vereinbarte Pauschale entstanden ist.

§ 8. The guest reserves the right to prove that no loss has occured to the contracting partner 103rooms through the non-utilisation of a booked room / apartment, or that the loss is lower then covered by the agreed estimated amount.

§ 9. Ist der Besteller nicht gleich dem Vertragspartner / Gast, so haften beide gesamtschuldnerisch.

§ 9. If an agent makes a booking on behalf of a guest, the agent and guest are jointly liable.

§ 10. Die Gebühren bei Um- und Abbestellung des/ der Zimmer / Apartments entnehmen sie bitte der 103 rooms Preisliste die hier zu finden ist.

§ 10. For information on charges regarding amendments and / or cancellation of arranged bookings please refer to the 103rooms price list 2009 .

§ 11. Der Vertragspartner / Gast haftet gegenüber 103rooms im vollem Umfang für durch Ihn selbst, seine Erfüllungsgehilfen oder seine Gäste, verursachte Schäden an Gebäude und Inventar sowie für abhanden gekommene Gegenstände.

§ 11. The guest is liable to 103rooms for any and all damage caused to the building or fixtures, as well as any lost or missing items, whether these were his / her own responsibility, or through the responsibility of anyone he / she invited or allowed into the room.

§ 12. Soweit wir für den Gast auf dessen Anforderung Fremdleistungen gastronomischer, technischer, dekorativer oder sonstiger Art von Dritten vermitteln, handeln wir im Namen und auf Rechnung des Gastes. Der Gast haftet für die pflegliche Behandlung und ordnungsgemäße Rückgabe dieser Gegenstände und stellt uns von allen Ansprüchen Dritter frei.

(*) Frühstück und weitere gastronomische Leistungen können selbstverständlich gegen gesonderte Rechung in der „103Bar“ im Erdgeschoss bezogen werden.

§ 12. Insofar as we liaise with external services on request of the guest, be they caterers, technical services, decorative services or any other kind, we act on behalf of and at the cost of the guest. The guest is liable for the appropriate handling and orderly return of any leased goods and will indemnify 103rooms from any claims made by third parties.

(*) Breakfast and other catering services can, of course, be obtained in the „103Bar“ as situated on the ground floor. A seperate bill will be issued.
